2007年,將近二千名移工、本地支持者走過台北東區街頭,大聲以越南、菲律賓、印尼、泰國母語喊出:「我要休假」,為不受勞基法保障休假權的家務移工請命。
今年的遊行訴求討論很多次,很無奈的,我們的訴求是「還沒休假」。有的記者說:「這個訴求你們喊了十幾年了。有沒有新花樣啊?」可是,家務移工沒有休假權已經17年了!藍綠政黨輪流執政,弱勢處境完全沒有轉變。
我們主張,休假權是基本人權。
我們要求,弱勢家庭應受社福挹注、看護工納入勞基法保障!
我們願意,協同在台灣貢獻付出的外籍勞工,共同走上街頭!

依「全民健康保險法」第十條規定,不分本外籍人士,凡在台受雇於公私營機構,或連續居留台灣四個月以上,就應加入健保。但目前,卻有二群因配合政策而合法留滯台灣的人,擁有合法工作權,且連續合法居留長達一年至二十年不等,但因移民署所核發的是「臨時停留證」而非「居留證」,而無法加入全民健康保險,被剝奪了基本的醫療權!

在勞委會樓下,突圍堵到行政院長吳敦義,把移工要求「我要休假」的文宣、頭帶遞給他,覺得很爽!但是回來看了新聞,卻是一整個爆笑跟荒謬。
而這個荒謬感,無論如何要把它記下來,一來實在是很好笑,二來留給研究媒體/政治的學者們一個活生生的有趣素材。
[Forum] White collar migrant workers/ foreign bushiban teachers' rights and regulations
Hello everyone!
We are TIWA (the Taiwan International Workers’ Association, http://www.tiwa.org.tw). TIWA is an activist organization established in 1999. For the past 10 years, we have helped migrant workers (primarily Southeast Asian blue collar and domestic workers) on a case-by-case basis and helped them organize to fight for their rights, as well as advocating for more progressive labor policy in Taiwan.
Recently, a lot of white collar migrant workers (especially bushiban English teachers) have been coming to our office asking for help. Their problems include: the employer isn’t providing enough work hours; overtime hours aren’t being counted according to the law; they are being harassed when they try to change jobs; employers are asking them to do illegal work (for instance, to work at a place not specified in their contract or work not related to teaching); the legality of work at summer school programs isn’t clear; etc.. In many situations, foreign English teachers don’t know what to do when their labor rights are violated, and the information that government bureaus provide in English is often inadequate or contradictory.
Therefore, in order to help everyone get a better understanding of their rights and how to protect them, we are organizing a labor education forum on the rights and regulations for foreign bushiban teachers in Taiwan. The forum will take place on the afternoon of December 6 (Sunday), 2009.
【座談會】白領移工/外籍補習班教師相關權益和規定
近來,白領移工(特別是補習班的英語教師)到我們協會求助的案件有增多的趨勢。案件問題包括:雇主工作時數提供不足、加班費給付不符法令規定、轉換雇主被刁難、被要求從事非法工作(含工作地點不符申請地點、從事教學以外的工作)、暑期營隊教學的合法性等等問題。很多狀況顯示,外籍英語教師在權利被侵害時,不知如何申訴;政府部門提供的訊息不充分時,不知如何求助等等。
因此,為了讓大家可以對自我權利保障有更進一步的認識,我們將在12/06(日) 下午,以在台白領移工/外籍補習班教師相關權益和規定為主題,舉辦一場勞工教育的座談會。

小機是一個機器人,她來自東南亞,為了追求幸福,遠渡重洋來到台灣工作;卻因缺乏法令保障,在台灣這個所謂的人權國家,連基本人權──休假、喘口氣的權力都沒有!
在台灣社會裡,還有十七萬名像小機一樣的女性,但她們不是機器人,是家務勞工。不斷工作的日子,就連機器人也會累,更何況是有血有肉、活生生的人?
2009移工大遊行,我們希望徵求本次遊行的象徵圖示:以機器人「小機」為主角,傳達出「就算是機器人也會累」的意象。
我們會在徵詢移工的意見後,選出最受歡迎的「小機」,作為今年移工大遊行的象徵圖示。

Người máy cũng biết mệt -Tiểu Cơ
Thiết kế tranh cho cuộc biểu tình của Di công với chủ đề:
“Người máy cũng biết mệt -Tiểu Cơ”
Tiểu Cơ là một người máy đến từ Đông Nam Á, vì muốn cải thiện cuộc sống đã vượt đại dương tới Đài Loan làm việc, nhưng không có luật pháp bảo vệ, tại Đài Loan một đất nước được coi là có nhân quyền, ngay đến nhân quyền cơ bản-nghỉ phép để xả hơi một chút cũng không có!
Trong xã hội Đài Loan, vẫn còn 170 ngàn nữ công giống như Tiểu Cơ, nhưng họ không phải là người máy, họ là những nữ giúp việc gia đình. Làm việc liên tiếp không ngừng, đến người máy cũng biết mệt chứ đừng nói tới là con người bằng xương bằng thịt.
Dự tính 13/12 (Chủ Nhật) tiến hành cuộc biểu tình lớn của Di công năm 2009, chúng tôi hi vọng tìm được bản vẽ cho cuộc biểu tình này: chủ đề lấy người máy “Tiểu Cơ” làm nhân vật chính, thông qua đó bày tỏ ý tưởng “cho dù là người máy cũng biết mệt”.
Sau khi chúng tôi trưng cầu ý kiến của lao động nước ngoài, chọn ra “Tiểu Cơ” được yêu thích nhất, sẽ lấy đó làm biểu tượng cho cuộc biểu tình của Di công năm nay. Bất luận bạn là bạn của Tiểu Cơ hay chính là Tiểu Cơ, xin thông qua nét họa và sức sáng tạo, hãy gia nhập vào hàng ngũ giành lại nhân quyền cho Di công cùng chúng tôi.

【Call for Contribution】The design for "Xiao-Ji the Robot in ‘Robot Also Gets Tired’"
Xiao-Ji is a robot, and she is from Southeast Asia. In order to pursuit her happiness, she comes across the big ocean to work in Taiwan; however, due to lack of legal protections, she does not even enjoy the basic human rights to take day-off and take rest in this so-called “country that upholds human rights”!
There are 170,000 more women like Xiao-Ji in Taiwan society, though they are not robots but household service workers. Working around the clock without any break, even a robot also gets tired, let alone for a real person in flesh and blood.
For the Migrant Workers’ Rally 2009, we want to call for contributions for a symbolic icon, with “Xiao-Ji” the robot as the main character, to convey the notion: "Even a robot also gets tired."
After consulting with migrant workers for opinions, we will select the most popular “Xiao-Ji” as the symbolic icon for the migrant rally this year.
No matter you are a friend of “Xiao-Ji” or “Xiao-Ji” in person, please come and join our ranks through your brush and creativity, fighting for the migrant rights!
Si Xiao-Ji ay isang robot na galing sa timog silangan. Tinawid niya ang malawak na karagatan papuntang Taiwan at nagtrabaho sa pag nanais na makamtan niya ang kaligayahan. Sa kakulangan ng legal na proteksiyon hindi man lang niya nakamtan ang karapatang na magkaroon ng araw na pahinga dito sa bansang na tinaguriang nagtataguyod ng mga karapatan ng mga tao.
Mayroong 170,000 na kababaihan dito sa Taiwan na katulad ni Xiao-Ji, pero hindi sila robot. Sila ay mga naninilbihan sa bahay. Kung ang robot ay napapagod sa maghapon at magdamag na pagtatrabaho, ano pa kaya ang tao na may dugo at laman ang di mapagod.
Para sa 2009 Rally ng mga Migrante, kami ay nanawagan na magpadala ng simbolo na maglalarawan sa pinakatanging panauhan na si “Xiao-Ji” na robot na may ganitong kahulugan “ Kahit ang robot ay napapagod.”
Pagkatapos isanguni sa mga migrante ang kanilang mga pananaw ay pipiliin ang pinaka makahulugan simbolo na larawan para sa rally ng taong ito,
Kaibigan ka man ni Xiao-Ji o ikaw man yon, maari lamang po lumahok kayo sa pakikipag laban ng karapatan ng mga migrante sa pamamagitan ng inyong pinsel (brush) at pagka malikhain.

家務移工引進十七年了,依然是法外孤兒!
The migrant household service workers (HSWs) have been introduced [to Taiwan] for 17 years, and the legal protection is still beyond the reach of these orphans of labor-right!
2003年劉俠事件起,移工團體串連提出「立法保障家務工」,多次召開研討會、公聽會、記者會、遊行抗爭,並提出「工人版家事服務法」送進立法院,但官方卻一再迴避、拖延。這6年中,已經歷過許多慘痛的家務工因休息不足、休假不夠而導致傷人或自殺的悲劇。
Ever since Liu Hsia event took place in 2003, the migrant advocates had linked together to promote the "legislation for HSWs protection" through many seminars, public hearings, press conferences, demonstrations, and had submitted the workers’ version of "The Household Service Act" to the Legislative Yuan. The government, however, repeatedly chooses to ignore and delay to address the issue. For the past 6 years we have experienced more depressing tragedies where the HSWs, due to lack of rest or day-off, inflicted injury upon others and even took the lives of their own.

莫拉克颱風重創南台灣,造成嚴重的災害與傷亡。連日來數千名災民忍痛、安全撤離面目全非的家園,但有許多焦慮的家人仍積極尋找生死未卜的親友。特別是移民、移工遠在東南亞、中國大陸的家人更是憂心如焚,不知如何跨海查詢她(他)們在台安危。

Petition for a Reduced Sentence for the Injured Worker Liu Hanghuang on Humanitarian Grounds
On 16 June 2009, Liu Hanghuang, a factory worker in Dongguan, fatally stabbed two of his Taiwanese employers and left a third critically injured. This is definitely an unbearable tragedy for both sides, especially an irreparable regret for the family of the Taiwanese businessmen.
However, based on the following reasons, we hope that the courts in China can take into consideration the extenuating circumstances.
